Our hearts go out to the family and loved ones of Melissa Riley, who tragically lost her life due to a medical mistake. We are humbled to have played a role in securing a $5 million settlement on behalf of her estate in the Court of Claims. This outcome is a testament to our team’s unwavering commitment to seeking justice for those who have been harmed by medical malpractice.
A tragic medical incident
The case involved a tragic incident at The Ohio State University Wexner Medical Center, where a 40-year-old mother of three, Melissa Riley, underwent a robotic-assisted thymectomy procedure to treat her myasthenia gravis. Unfortunately, the thoracic surgeon, Dr. Robert Merritt, injured the innominate vein during the surgery, resulting in severe bleeding and the need to convert to an open procedure.
A devastating consequence
Despite the gravity of the situation, Dr. Merritt failed to adequately control the bleeding, and Melissa was left profoundly hypotensive for approximately 45 minutes. It was not until the cardiac surgery team was called in for assistance that the true extent of the damage was revealed. The cardiac surgeon was forced to “crack the chest” to repair the 2.5-to-3-inch tear in the innominate vein, but it was too late. Melissa’s brain had suffered catastrophic and permanent injury due to the prolonged uncontrolled bleeding, and she tragically passed away just three days after surgery.
A measure of justice
Our team of experienced attorneys worked diligently to build a strong case, gathering evidence and expert testimony to demonstrate the clear negligence of Dr. Merritt and The Ohio State University Wexner Medical Center. We are pleased to have secured a $5 million settlement on behalf of Melissa’s estate, which will provide some measure of comfort and support to her loved ones.
A commitment to accountability
This settlement serves as a reminder that medical professionals have a sacred duty to provide competent care to their patients. When they fail to meet this standard, they must be held accountable. Our law firm is committed to fighting for the rights of victims of medical malpractice and ensuring that they receive the justice and compensation they deserve.
A legacy of advocacy
We extend our deepest condolences to Melissa’s family and loved ones, and we are honored to have had the opportunity to represent them in this case. We will continue to advocate tirelessly for victims of medical malpractice, working to create a safer and more accountable healthcare system for all.
