$350,000 Settlement | Franklin County

A prospective business owner hired an attorney to assist with an asset purchase agreement, for the purpose of purchasing all assets of a current business “free and clear,” and forming a new business entity. The attorney failed to advise the prospective owner about the potential that the assets may be encumbered by liens and other debts, and therefore, failed to conduct a search for such liens. The asset purchase deal proceeded, but after closing, the purchaser learned of numerous liens on the assets purchased, which negatively impacted the value of those assets. The negligence of the attorney in failing to advise about taking steps to discover those liens, resulted in significant financial loss to the purchaser.

Mr. Doe was represented by AZ Law Firm in pursuing a medical negligence claim based on the failure to diagnose a heart attack. While representing Mr. Doe, AZ learned that the statute of limitations may have expired on his medical negligence claim but failed to timely file a lawsuit against the previous lawyer who was responsible for the statute of limitations expiring. As a result, Mr. Doe's statute of limitations for legal malpractice expired. Mr. Doe brought suit against AZ for failing to timely file the legal malpractice claim and ultimately agreed to settle his claims against AZ for $250,000.

After learning that his ex-girlfriend intended to put their child up for adoption, an expectant father hired a family law attorney to assist him with establishing his paternity rights and objecting to any adoption. The family law attorney negligently advised the expectant father to wait until after the child was born to register with the putative father registry, which requires that a putative father register “before or not later than fifteen days after the birth of the child” to preserve his right to object to an adoption. See R.C. 3107.062. Unfortunately, the expectant father did not learn of the birth of the child until more than 15 days had passed, as the baby was born before the due date and the mother of the child waited until day 16 to advise the expectant father of the birth, thus losing his paternity right and right to object to the adoption.

DOE v. CRTC

A $101,000 settlement for a 14-year-old girl who was a resident at a treatment center for troubled youth. She and another resident engaged in one incident of sexual relations, which the girl claimed was nonconsensual despite flirtatious notes sent to the boy. The case was pursued on theory of assault due to inadequate supervision and the statutory inability of a minor to consent to sexual relations as a matter of law.
